Nursing Home Case

A nursing home case is a legal suit that is filed against a nursing home care facility for acts of neglect or abuse against a nursing home resident. A nursing home case may be filed by the family and loved ones of a resident who has suffered as a result of nursing home malpractice. A nursing home case can be filed with the help of an experienced and qualified legal professional who can protect and maximize your legal interests.

Every year in the United States, thousands of nursing home residents suffer from neglect or abuse, yet many do not pursue their right to file a nursing home case against their offender. Government studies have revealed that nearly thirty percent of all nursing homes across the nation have committed gross acts of negligence or abuse against those in their care. Routine government nursing home evaluations typically find that 90 percent of all nursing homes are in violation federal nursing home law. These violations do not always elicit a nursing home case; rather these violations can range from potential minor resident impact to the immediate threat of physical harm.

It is important for nursing home residents and their loved ones to understand their rights to a set quality of care and life in the nursing home environment. Federal and state laws provide a number of standards that must be met by nursing care facilities. Government agencies routinely inspect nursing homes to identify nursing home case situations which violate law and pose a threat to the safety, health, and well being of residents. The results of these evaluations are made available to the public.

A nursing home case can involve any nursing home resident who has suffered injury or other losses as a result of nursing home malpractice. A nursing home case can involve any aspect of nursing home care including staffing, safety, treatment, facility, and the like. A nursing home case can involve physical damage caused by nursing home negligence such as bed sores, dehydration, malnutrition, untreated pain or medical conditions, fractures, infections, and the like. A nursing home case may also involve non-physical damages such as financial exploitation, mental or psychological abuse or neglect, and offenses of this nature.

Through a nursing home case, the victims of these atrocities can seek compensation for their losses. A nursing home case often develops when abuse and/or neglect is serious and other remedy options have been exhausted. In addition to compensatory awards, a nursing home case can also involve corrective action required of the nursing facility. The victim will have the right to transfer to another nursing home care facility and other remedial actions may be made.

If you or a loved one has suffered as a result of nursing home abuse or negligence, you may wish to contact a qualified and experienced legal professional who can evaluate your nursing home case to determine your legal rights and options. If you suspect that you may have a nursing home case you may also wish to contact an attorney who can evaluate your situation.
