"Judge Overturns Guilty Verdict in MN Nursing Home Abuse Case"

In a heated court battle over a Minnesota nursing home abuse case Benton County is asking that state's Supreme Court to take a closer look at a lower court's ruling that overturned a jury's guilty verdict. The lower court suggested that there was insufficient evidence and that the jury was incorrect in making a guilty verdict against Jackie Gondrez, a caregiver at the Country Manor Nursing Home in Sartell.
Jackie Gondrez was convicted of mistreatment of a confined person and disorderly conduct by a caregiver, charges stemming from a 2002 incident. The initial complaint alleged that Gondrez and another caregiver bathed a male and female resident at the same time where they saw each other naked. The residents were aged 76 and 82 and both had dementia.
The complaint alleges that Gondrez made inappropriate and sexually suggestive comments at the time of the bathing. The other caregiver pled guilty, but Gondrez chose to fight the claims.
