$489,000 Awarded in Nursing Home Abuse Suit

A jury has awarded $480,000 to a nursing home abuse victim in a lawsuit against a nursing home in Lexington, Kentucky.

The Davidson County jury decided that Living Centers – Southeast Inc., then-owners of Brian Center Nursing Care of Lexington, must pay Emma H. King $480,000, finding them guilty of neglect.

According to court documents, King checked into the nursing home in May of 2002 for care during her rehabilitation from a knee replacement surgery. During her stay, she developed numerous severe pressure sores as a result of the negligence. The sores eventually caused her permanently disability.

Within two months, King had dropped nearly 20 lbs in weight, become dehydrated, and developed pressure sores in her lower back. She also later developed pressure ulcers on her knees, court documents said.

The suit said that the sores became infected, and King developed a fever. She required hospitalization at this point.

She was admitted back to the Brian Center, but she never fully recovered, and eventually became unable to use her legs. King’s family took her out of the Brian Center in August 2003.

As a result of her injuries, King was forced to undergo surgery on a weekly basis for a year.

King’s attorney, James Roane, said that lack of staffing often causes these types of abuse and negligence injuries in nursing homes.

“It was the most clear case of negligence I have seen,” Roane said.

Roane said the Brian Center originally offered to settle for $38,000, which according to Roane, “wasn’t even enough to pay for the medical bills.”
