Lawsuit Filed Against Nursing Home For Rape Charges
July 17, 2007
The HRA Village nursing home in Texas City, TX, is being accused of kicking out a mentally disabled woman after she reported that a staff member had raped her.
The Accusations
A 28-year-old woman was reportedly locked out of HRA when she claimed Henry Lewis Jones, 54, had raped her.
After a rape kit tested her positive for semen, the nursing home still refuted her allegations.
“They absolutely knew the woman had been abused,” says Tony Buznee, the attorney of the woman’s mother, who filed the suit.
According to the claim, the staff at HRA Village “created an atmosphere of oppression” and the residents were frequently yelled at and confined to their rooms as punishment.
Jones allegedly began sexually abusing the woman after she reported him to HRA officials for fondling other residents and watching them shower.
Both the woman and her mother complained to supervisor about Jones behavior but were accused of lying and ignored.
Even after the test results were presented, HRA continued to bill the woman’s mother even though she refused to return to the home and was no longer living there.
Charges Made and Lawsuit Filed
On March 22, Henry Lewis Jones was indicted on sexual assault charges for anal penetration of the disabled woman.
The lawsuit also blames HRA for the abuse and for failing to report the allegation of abuse to the Texas Department of Aging and Disability Services, which is required by law.
