Senior Sues Nursing Home
January 22 , 2007
An 81-year-old woman has filed a lawsuit against the nursing home she used to reside in alleging neglect and abuse.
Rose Capriotti claimed in her lawsuit, filed in Cook County court, that during her two-month stay at the home she suffered numerous bedsores and fell on her head.
The home, Prairie Manor, is run by Care Centers Inc, which has also been named as a defendant in the case. The company runs 26 homes in the Chicago region.
The Events
Capriotti suffered a stroke from which she was recovering at the Prarie Manor Nursing & Rehabilitation Center. Within the first week of her stay there, nursing home employees sat Caprioti upright despite the fact that her balance had been affected by the stroke. She fell, hitting her head, said Capriotti’s lawer, Susan Novosad.
“A physician said he thinks (Capriotti) may have sustained another stroke after the April 3 fall,” said Novosad.
The Prarie Manor staff first noticed the bedsores on May 5, said Novosad. No one told Capriotti’s family about the sores until they became aware of them on may 15, Novosad said.
“Pressure sores develop over a period of time, and there would be evidence of a pressure sore’s existence prior to the time it was at its most severe staging,” Novosad said.
The Lawsuit
According to the lawsuit, which seeks damages of at least $50,000, prairie manor staff acted negligent and violated state law by failing to prevent “the development of skin breakdown and infection.”
The lawsuit also claims that the staff did not properly evaluate or care for Capriotti.
“(Bedsores) don’t just go from zero to stage four,” said Novosad. “The only way (the staff) could not be aware is that no one evaluated her.”
