Texas Jury Awards $160M in Nursing Home Case April 26, 2006
A Texas jury has returned one of the largest nursing home abuse case verdicts in San Antonio civil litigation history. The estate of Tranquilino Mendoza will receive a $160 million award for damages caused by Mendoza's violent roommate at the Comanche Trail Nursing Home, affiliated with Summit Care Corporation.
The nursing home abuse case involved claims that the nursing home knowingly paired Mendoza, a frail 81-year-old, with a roommate who was violent and mentally ill. According to witnesses in the nursing home abuse case, the roommate committed at least 30 prior acts of violence before being paired with Mendoza.
Soon after the two began sharing living quarters, the roommate assaulted Mendoza, causing serious and irrecoverable trauma.
The jury in the nursing home abuse lawsuit found Summit Health Care and two nursing home employees were responsible for the assaults and their effects on Mendoza.
Mendoza died less than three years after the attacks due to unrelated causes.
